What Should You Know about Divorce in Washington ?

If you plan to get divorced, there are a few things you should know.

  • The waiting period: One of the first things to know is that you do have a waiting period you must fulfill before you can divorce. That waiting period is at least 90 days, starting when the divorce petition is filed. There is also a right to appeal, in case you may need that.
  • The grounds for divorce: Divorces are allowed so long as there is a real, irretrievable breakdown of the marriage. This is generally the basis of “no-fault” divorce, and there are no other grounds recognized in the state. It’s not necessary to prove that either you or your spouse is at-fault for the divorce.
  • Community property rules: Washington is also one of few community property states in the U.S. What that means is that you and your spouse will be expected to divide your marital property approximately in half. This is negotiable if you and your spouse can make an agreement outside court.

As you can see, there are many factors playing a role in your divorce. Our website has more on what to expect if you pursue a divorce in Washington.
